Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Pushd application or website at pushd.fit (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms apply to all users, including free and paid subscribers. We reserve the right to update these Terms at any time. Continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement. If you are under 18, you represent that you have your parent or guardian's consent.

3. Account Registration

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • Each person may maintain only one account. Duplicate accounts may be removed.

4. Subscriptions and Payments

4.1 Free Tier

The Service is available at no cost with limited features ("Free Tier"). Free Tier features may change at any time.

4.2 Paid Subscriptions

Pro and Elite subscriptions are billed through the App Store (iOS) or Google Play (Android) on a monthly or annual basis. Prices are displayed in the app prior to purchase.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage and cancel your subscription in your App Store or Google Play account settings.
  • No refunds are provided for partial subscription periods, except where required by law.
  • We reserve the right to change subscription pricing with reasonable notice.

4.3 Promo Codes

Promo codes may be issued at our discretion. They are non-transferable, have no cash value, and may expire or be revoked at any time.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Attempt to gain unauthorised access to any part of the Service or its infrastructure
  • Reverse engineer, decompile, or disassemble the Service
  • Upload content that is abusive, offensive, defamatory, or infringes third-party rights
  • Use the Service to spam, harass, or harm other users
  • Use automated tools (bots, scrapers) to access the Service without written permission
  • Impersonate any person or entity
  • Share your account credentials with others

6. User Content

You retain ownership of content you create (workouts, routines, photos, etc.). By posting content publicly, you grant Pushd a non-exclusive, royalty-free licence to display and distribute that content within the Service.

You are solely responsible for content you post. We reserve the right to remove content that violates these Terms without notice.

7. AI Features

Pushd uses artificial intelligence to power certain features including the AI Coach, AI Workout Planner, AI Meal Plan generator, and Recovery Insights. All AI-generated content is provided for general informational and fitness purposes only. It does not constitute medical, nutritional, or healthcare advice.

7.1 No Medical or Clinical Advice

AI-generated workout plans, meal plans, nutritional recommendations, and coaching responses are not a substitute for professional medical, dietary, or physical therapy advice. Always consult a qualified healthcare professional — including a licensed physician, registered dietitian, or certified personal trainer — before beginning a new exercise programme or making significant changes to your diet, particularly if you have or suspect any medical condition, injury, or physical limitation.

7.2 Accuracy and Limitations

  • AI responses are generated automatically and may not always be accurate, current, or appropriate for your individual circumstances.
  • Pushd does not verify the accuracy of AI-generated content. Use your own judgement and consult a professional where appropriate.
  • AI features are clearly labelled within the app. Any content labelled "AI" or "AI-generated" is produced by automated systems, not by licensed professionals.
  • Meal plans are general suggestions only. Pushd is not a Registered Dietitian and does not provide medical nutrition therapy.

7.3 Liability

We are not liable for any injury, illness, adverse outcome, or loss resulting from your use of or reliance on AI-generated content. By using AI features, you acknowledge and accept these limitations.

8. Health Disclaimer

Exercise and physical activity carry inherent risks. By using fitness features of the Service, you acknowledge that you are voluntarily participating in physical activity and assume all risks associated with such activity, including risk of injury, illness, or death.

Pushd is not a medical provider, licensed gym, or registered health service. Nothing in the Service — including workout plans, exercise instructions, recovery scores, or AI coaching responses — should be interpreted as medical advice, diagnosis, or treatment.

If you experience pain, dizziness, shortness of breath, or any other concerning symptoms during exercise, stop immediately and seek medical attention. Do not rely on the app to make decisions about your health.

Pushd is not responsible for any injury, loss, or damage arising from your use of the Service.

9. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, icons, software, and the "Pushd" name and brand — are owned by Pushd and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. You may delete your account at any time from Settings → Delete Account. Upon termination, your right to use the Service ceases immediately and your data will be deleted per our Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PUSHD AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall be resolved through good-faith negotiation first. If unresolved, disputes shall be submitted to binding arbitration.
